Suppressor law
Carve-out in flux
Legal, but the state exception is written for federally registered owners. Since the ATF's October 9, 2026 policy, new purchases cannot register — the statute is untested for them.
| Statute | 13 V.S.A. § 4010 |
| Notes | § 4010(b) prohibits manufacture/making/import of gun suppressors EXCEPT by licensed manufacturers/importers registered per 26 U.S.C. § 5802 or persons making one in compliance with 26 U.S.C. § 5822 — federal-keyed carve-out language present (post-Oct-9 unregistered manufacture/import cannot satisfy it). § 4010(c) prohibits USE except law enforcement, National Guard, federally licensed testing, range use, and § 4701 hunting; possession is not an offense. Penalties: $500 (manufacture/import) / $50 (unlawful use). Text current through the 2025 session (2021 No. 165 Adj. Sess. amendments included). |
| Hunting | Legal — taking game as authorized under 10 V.S.A. § 4701 is an express exception to the suppressor-use prohibition (13 V.S.A. § 4010(c)(5)); sport-shooting-range use is also excepted (§ 4010(c)(4)). |
Federal context: suppressor tax $0 since Jan 1, 2026 (OBBBA); ATF stopped enforcing NFA approval/registration Oct 9, 2026. State law is unchanged and independently controls.
